Movant was charged with aggravated battery for causing serious injuries to one XXXXXXXXX on February 7, 1996.

Movant was found to have committed this act and was sentenced to the maximum allowable penalty of five years restrictive custody in the physical custody of the Department of Children and Youth Services.

After Movant was taken into custody his shoes were taken from him by the police officers as "evidence".

The shoes have not been returned to Movant, Movant’s family, or counsel nor has Movant been provided any scientific reports related to this evidence.

WHEREFORE, Movant demands:
